1.
The customer agrees to pay for the service in full (usually in advance)
at the agreed rate. Payment is accepted by VISA, MasterCard via PayPal
, or cheque. VAT is charged at the prevailing rate.
2. Domain names, when fully paid for, belong to you the customer, and may be transferred at any time.
2.1. DNS changes must be requested by email, and may carry an admin charge of £15 +VAT
2.2. IPS-TAG transfers, must be requested by the legal owner of the domain name, and must be sent to us via FAX. Once received we will send a confirming email to the registrant, and once confirmed will be processed.
IPS-TAG changes will not be made if there are any outstanding monies owed on the account. Transfers carry a fee of £37.50 + VAT, and can take up to 4 business days to complete.
3. The customer agrees not to use the service for the storage or
transmission of any obscene, defamatory, threatening, racist or
other offensive material.
4. The customer agrees not to use the service for any illegal or
damaging activities.
5. The customer agrees not to divulge his account and password details
to any third party either on, or offline.
6. The customer agrees not to engage in any activity that may interfere
with the provision of effective service to any other UkWebNames
customer or any other Internet user.
7. The customer agrees not to attempt to gain unauthorized access
to systems not under their control, nor to engage in any activity
which may compromise any aspect of the service.
8. The customer agrees not to use his electronic mail service for
unsolicited mass (bulk) mailings ("spamming").
9. The customer agrees not to use the service for any activity that
consumes unreasonable amounts of bandwidth.
10. The customer agrees to indemnify and hold UkWebNames harmless
on a full indemnity basis (including legal costs) from any claims
resulting from said customer's use of the service which may
damage another party.
11. The customer may cancel the service at any time. Refunds for
any unused whole months of service will be made at our discretion.
12. UkWebNames reserves the right to impose a limit for high web
site traffic if it consumes our resources excessively. In such cases
a surcharge (not exceeding £0.10/Mb) may be imposed. (No extra charge
will be incurred below a transfer of 500Mb per month).
13. In performing its obligations under this Agreement, UkWebNames
shall at all times exercise the reasonable skill and care of a competent
Internet access provider. However, we exercise no control whatsoever
over the content of the information passing over the network. We
make no warranties of any kind, whether express or implied for the
service we provide. We also disclaim any warranty of merchantability
or fitness for a particular purpose. We will not be responsible
for any damage suffered by you as a result of our service. This
includes loss of data resulting from delays, non-deliveries, misdeliveries,
service interruptions or supplied software. Use of any information
obtained via the service is entirely at your own risk.
14. UkWebNames may suspend provision of a service in the event that
emergency works need to be carried out to the System or for any
other reasonable requirement. We shall endeavor to give the customer
reasonable notice of any suspension and to restore normal service
as quickly as practicable. We shall not be liable for any loss,
damage or inconvenience suffered by you as a result of any suspension
pursuant to this Clause.
15. In the unlikely event that UkWebNames is unable to continue
service provision, for whatever reason, refunds to the customer
will be limited to any unused whole months of service.
16. UkWebNames's liability to the customer as a result of breach
of this Agreement by negligence shall be limited to the outstanding
value of payment already made by said customer, for which service
has yet to be delivered. Notwithstanding anything else in this Agreement
neither party shall in any event regardless of the form of action
arising in connection with this Agreement whether in contract tort
or strict liability and including without limitation negligence
of any kind whether active or passive be liable to the other for
indirect or consequential losses or otherwise for harm done to business,
lost revenues, loss of anticipated savings or lost profits.
17. UkWebNames reserves the right to suspend or terminate the service
without warning, to you the customer, if you are in breach of this
agreement. In such a case you agree to pay us any reasonable expenses,
including legal and collection agency fees incurred in enforcing
our rights under this Agreement. We shall also at our option suspend
or withdraw service. In such an event a refund will not usually
be offered.
